and completed “Race, Racism, and the Law.” You also know that he remembers the case of
Officer Justin Volpe who sodomized Abner Louima with a broomstick in 1997 (page 14, Racism
and the Law) and that some of Mr. Barnacle’s favorable comments about Officer Volpe’s actions
have catalyzed your concerns and anxieties.
In various relatively recent parties that you have attended where he has been present, Barnacle has
often said that when he goes on patrol, he’s going to “get me some
or some ‘illegal
immigrants’ and watch the blood flow when he is a cop.” He also said “I’ll be the Volpe of SC!”
and “it’s time for some real ass kicking of these so-called people of color.” You have also seen
white nationalist literature on his laptop and also seen the tattoo on his arm that reads “WHITE
PRIDE” (these are fully protected under the First Amendment). But you also know that Barnacle
is well liked among fellow students and that he often invites them to his home for parties. Your
even attended one yourself and actually enjoyed the event. You noticed that Barnacle’s apparent
girlfriend had some bruises on her arm that she tried to conceal. You couldn’t be sure whether
she was a victim of abuse, but you certainly had suspicions. You’re not 100% sure that Barnacle
meant everything he said; it could be the alcohol talking.
In an informal conversation you recently had, Barnacle mentioned that he’s been offered the USC
job and has accepted and will start in August. . You worry he is the kind of police officer who
could wind up like Justin Volpe. You also know that the neighborhoods surrounding USC are full
of racial and ethnic minorities. But you know that saying anything would brand you a “rat” and
that anything you say might not do any good at all; in fact, if it got out, there might even be some
danger to you because Mr. Barnacle has a lot of friends. You are not sure what, if anything, you
should do. You are not sure procedures, if any, are available for you to follow. What, them, will
you do, if anything at all? Write a clear and detailed 6-7 page essay, giving your decision and the
reasons supporting it: (Although not specifically relevant to this scenario, the book Ethical
Ambition by Derrick Bell is a valuable resource).
4. Constitution Week in a U.S. observance to commemorate the adoption of the United States
Constitution. It runs annually from September 17 to September 23, although it is not an official
national holiday. President George W. Bush officially declared the inception of this week in
September 2002. In 2004, Congress declared that Constitution Day should be observed in schools
each year on September 17 with educational programs about the history and signing of the
Constitution. The two requirements of the law were that the head of every federal agency provide
each employee with educational materials concerning the Constitution on the 17th of September
and that each educational institution that receives federal funds should hold a program for students
every Constitution Day. Some states, local governments, and civic organizations also hold essay
contests in conjunction with Constitution Day.
Here is another hypothetical: your old high school, complying with the law, has decided to “get in
on the act on the occasion of the 232st anniversary of the ratification of the Constitution. It
decides to sponsor an essay contest for all its alumni: “The Majesty of the United States
Constitution.” The winner’s essay will be shared in an assembly with the entire student body of
your old high school. Because the contest also carries a generous cash award, with high
university and other costs, and student loan debts looming, you decide to enter the contest.

origins) to high school students. You are free to go in any direction you choose. You can offer

Your presentation should be written and focus specifically on what, if anything, America should
do about this recent police misconduct. Because you are writing for a specific group (the
assembled students of Utah State University), you need to pay specific attention to how you
structure your presentation for maximum effectiveness to this particular audience. In other
words, be very aware of the generally conservative views of your audience. (You are not limited
to any particular viewpoint; although many, even most, students in Af. Am. 176 probably
regard police brutality and misconduct as a major problem, you could, for example, argue that the
highly publicized examples only reflect a few largely isolated and unfortunate examples of poor
policing in a generally fine institution and that police forces should be given even greater public

2. The UC Regents allow one UC student to serve for a year as a Student Regent. Imagine that
the Los Angeles Police Commission has decided to do the same by appointing one student to
serve for a year as a Student Commissioner. YOU have been selected. You have been requested,
as your first task, to submit a 6-7 page essay to the Commission on the problem of implicit bias
in policing and your personal proposal about changes in police selection and training
procedures that would address this significant issue of implicit bias.
This happens to be a theme we have explored in the first weeks of our class. It arose dramatically
in the case of Harvard Professor Henry Louis Gates. In week 3, your instructor mentioned a very
recent case at Barnard College in New York City. Other examples from Charles Ogletree’s The
Presumption of Guilt were also mentioned. Further examples can be found on page 26 of the
course text. Many other recent cases have occurred and substantial evidence exists about racial
profiling (see, for example, The Stanford Open Policing Project).
Indicate why you have chosen your particular reform about police selection and training (it may
be one or several) and then argue in depth why you believe it would have beneficial consequences
for the future in addressing the problems of implicit bias against racial and ethnic minorities. Your
proposal should be reasonably detailed, going beyond what we discussed in class. In composing
your answer, you should make specific reference to cases relevant to your proposal that are treated
in class discussions, readings, and/or the film we saw the first day of class. Obviously, any
specific policy about changes regarding police training or practices cannot fully address the
deeper issues of institutional racism in America, but it is certainly appropriate to note that reality
as part of your essay.
