What an exciting week! For this portion of the class we will be focusing on Ethical and Bioethical issues as they relate to medicine. Ethical and bioethical issues are a constant struggle that all healthcare workers will encounter at several points in their career. Since 400 B.C., medicine has followed principles that are important to patient care and are upheld within education and the community. In this module we take a closer look at medical law and ethics and why this topic must be studied on a consistent basis throughout healthcare and medicine. A common question that presents itself in relation to these bioethical issues is “Just because we can, should we?”

In the beginning of this course, you studied various ethical decision-making models. A critical thinking approach to ethical issues will assist in making the most important decisions for the patients and their families. Using ethical and bioethical decision making within the law includes knowledge of the history of ethics, codes of ethic, transplant rationing, biomedical research, and conflicts of interest.

Conscience Clause

In addition, ethical standards and behavior encompasses moral principles and practices, the customs of the medical profession, and the matters of medical policy. As noted earlier in this course, not everyone shares the same set of ethics or morals. In the health care field, one can evoke the conscience clause when facing a procedure or operation that they feel counters their personal ethics. These are state enacted laws that allow healthcare workers and facilities to choose whether they will participate in such procedures as abortion or sterilization based on their moral or religious principles.

Bioethical advances and issues related to reproduction

This module’s topic introduces us to topics that at times can be quite controversial. It includes abortion, surrogate motherhood, fertility treatments, and sterilization. Many people find themselves feeling strongly one way or another depending on the individual topic. As future healthcare professionals, you may either directly or indirectly interact in facilities that deal with these procedures. It is important to understand the definition of the various topics related to reproduction and contraception. As you check out the definitions below, start thinking about some of the various ethical and legal issues that surround each of these topics.

Fertility Treatments

Artificial insemination (AI): Injection of seminal fluid into vagina from husband or donor.

In-Vitro Fertilization (IVF): Ovum and sperm cells combined outside woman’s body with cells grown in laboratory and later implanted into woman’s uterus. In some cases, unused embryos are destroyed or may be frozen for possible future implantation.

Fertility Drugs: Drugs that are used to enhance the possibility of conception such as Clomiphene (Clomid).

Surrogate Motherhood: A contract is entered into by the surrogate mother and the infertile couple. The surrogate mother agrees to bear child for infertile couple, couple must pay for medical expenses of surrogate mother and abide by the terms of the contract.

Contraception Methods

Oral Contraceptives: These include your 28 day or 3 month to yearly cycle of birth control pills.

Condom: A barrier device that may be used during sexual intercourse to reduce the probability of pregnancy and spreading sexually transmitted infections such as HIV/AIDS.

Sterilization: Medically altering reproductive organs to terminate ability to produce offspring. May be surgical intervention such as vasectomy in the male or tubal ligation in the female. Usually elective procedure; can be therapeutic, incidental, or involuntary.

Eugenic Sterilization: Involuntary sterilization: considered to be unethical by many people. Must be proven to be in the best interest of cognitively disabled person.

Abortion

Spontaneous Abortion: Termination of pregnancy occurs naturally without any interference (miscarriage).

Induced Abortion: Termination of pregnancy is caused by artificial means (medications or surgical procedure).

Conscience Clause Revisited

If you have moral or ethical problems with the above procedures, remember that you can distance yourself from them by invoking the conscience clause. It is important to let your supervisor know during the hiring process if any of these procedures will pose an ethical issue so that you are not included in the process. By waiting to tell your supervisor, you run the risk of being called in to assist with one of these procedures. Communication up front will prevent this from happening.
